SizeMind Terms of Service

These Terms of Service ("Terms") govern your use of the SizeMind application ("App"), provided by DB Ecom Group LLC ("we," "us," or "our"). By installing or using SizeMind, you agree to these Terms.

1. Service Description

SizeMind is a Shopify application that provides:

• Personalized size recommendations for store visitors
• Size chart management for merchants
• Analytics on size recommendation usage and conversions

2. Account and Access

To use SizeMind, you must:

• Have a valid Shopify store
• Install the App through the Shopify App Store
• Grant the necessary permissions for the App to function
• Maintain the security of your Shopify account

3. Subscription and Billing

SizeMind offers multiple subscription plans:

• Free Plan: Basic size charts with limited features
• Starter Plan ($6.99/month): Personalized size finder, auto mapping, basic analytics
• Professional Plan ($14.99/month): Unlimited charts, confidence indicators, full analytics

All billing is handled through Shopify's billing system. Subscriptions are billed monthly and renew automatically. You may cancel at any time through your Shopify admin dashboard.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Reverse engineer or attempt to extract the source code
• Resell or redistribute the App without authorization
• Use the App in a way that could damage our reputation

5. Intellectual Property

SizeMind, including its code, design, branding, and documentation, is owned by DB Ecom Group LLC. You are granted a limited, non-exclusive license to use the App for its intended purpose. This license does not transfer any ownership rights.

6. Data and Privacy

Your use of SizeMind is also governed by our Privacy Policy. By using the App, you consent to our data practices as described in that policy.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT SIZE RECOMMENDATIONS WILL BE ACCURATE OR THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

9. Indemnification

You agree to indemnify and hold harmless DB Ecom Group LLC from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

10. Termination

We may suspend or terminate your access to the App if you:

• Violate these Terms
• Fail to pay applicable fees
• Engage in fraudulent activity

You may terminate your use of the App at any time by uninstalling it from your Shopify store. Upon termination, your data will be handled according to our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles.
